1. About us and these terms

This Site is operated by Warmthfoods Ltd, registered in England and Wales under company number 16317046 with registered office at 86-90 Paul Street, London EC2A 4NE. Our VAT number is GB 496490245 . We are a registered food business with Waltham Forest Council These Terms govern your use of walmth.co.uk; walmth.com and any orders. By placing an order you agree to these Terms.

2. Eligibility to purchase

You must be at least 18 years old and legally capable of entering into binding contracts to place an order. Alcohol products may only be purchased by, and delivered to, a person aged 18 or over. We operate Challenge 25 — if the person taking delivery looks under 25, the courier will ask for valid photo ID. We reserve the right to refuse delivery and cancel any order where age cannot be verified. It is a criminal offence under section 146 of the Licensing Act 2003 to buy or attempt to buy alcohol on behalf of someone under 18.]

3. Placing an order and contract formation

• When you place an order, you make an offer to buy the goods at the listed price. • We will send an order acknowledgement email confirming we have received your order. This is not acceptance. • A binding contract is formed only when we send a dispatch confirmation email. • We may decline orders where there has been a pricing error, items are out of stock, we suspect fraud, or (for alcohol) age cannot be verified.

4. Prices and payment

• All prices are in £ Pounds Sterling and include VAT where applicable. Note: most food is zero-rated for VAT in the UK, but some items (e.g. confectionery, soft drinks, hot food, alcohol) are standard-rated. • Delivery costs are shown separately at checkout. • We accept Visa, Mastercard, Amex, PayPal, Apple Pay, Google Pay. Payment is taken at the time of order. • Card payments are processed by [your payment provider]. We do not store full card details.

5. Product information, ingredients and allergens

In line with the Food Information Regulations 2014 and assimilated EU Regulation 1169/2011, product pages display the information you need before you buy, including: • Product name and description • Full ingredients list, with the 14 major allergens emphasised • Net quantity, storage conditions, and use-by/best-before dates where applicable • Country of origin, where required • Nutritional information per 100g/100ml and (where given) per portion Allergen warning: our products are produced in environments that may handle products which may contain allergens, e.g. nuts, peanuts, sesame, gluten, milk, egg, soya. If you have any allergy, please read product information carefully before ordering. Photographs are illustrative; actual products may vary slightly in colour, size, or appearance.

6. Pre-packed for direct sale (PPDS)

Under the Food Information (Amendment) (England) Regulations 2019 (commonly known as “Natasha’s Law”), and equivalent regulations in Scotland, Wales and Northern Ireland, food we pre-pack for direct sale is labelled with the product name and a full ingredients list, with allergens emphasised.

7. Delivery and returns

Delivery and returns are governed by our separate Delivery Policy and Refund & Return Policy, which form part of these Terms. See Delivery and Returns. Note that perishable food, sealed food once unsealed, and made-to-order items are excluded from the standard 14-day cooling-off right under regulation 28 of the Consumer Contracts Regulations 2013. Your statutory rights under the Consumer Rights Act 2015 always apply.

8. Your statutory rights

Nothing in these Terms affects your statutory rights as a consumer. Under the Consumer Rights Act 2015, goods we supply must be:• Of satisfactory quality • Fit for purpose • As described In addition, the Food Safety Act 1990 makes it an offence to sell food that is not of the substance, nature, or quality demanded. If food we supply is unsafe or substandard, you are entitled to a full refund or replacement.

9. Storage, handling and consumption

Once delivered, you are responsible for storing food correctly in line with the instructions on the packaging — in particular, refrigerating or freezing chilled and frozen items immediately on receipt. We cannot accept liability for spoilage caused by improper storage after delivery.

10. Acceptable use of the Site

You agree not to: • Use the Site for any unlawful, fraudulent, or harmful purpose • Attempt to gain unauthorised access, scrape, or interfere with the Site • Upload viruses or malicious code • Reproduce or resell any part of the Site without our written permission

11. Accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity on your account. Notify us if you suspect unauthorised use.

12. Intellectual property

All content on the Site — including text, images, recipes, photography, and branding — is owned by us or our licensors and protected by copyright and trade mark law. You may view and print pages for personal, non-commercial use only.

13. Our liability to you

We do not exclude or limit our liability for: • Death or personal injury caused by our negligence • Fraud or fraudulent misrepresentation • Breach of your statutory rights as a consumer • Defective products under the Consumer Protection Act 1987 • Any matter arising under the Food Safety Act 1990 that cannot be excluded by law • Any other liability that cannot be excluded under English law Subject to the above, our total liability for any loss arising from an order is limited to the price you paid for the goods. We are not liable for losses that were not foreseeable, losses not caused by our breach, or business losses.

14. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including extreme weather, strikes, pandemics, courier failures, supply-chain disruption, power or internet outages, or government action. Where such an event occurs, we will contact you and either extend the delivery time or, where the delay is significant, allow you to cancel for a full refund.

15. Product recalls

If a product we have sold to you is subject to a recall — for example due to an undeclared allergen, contamination, or a labelling error — we may contact you using the details we hold to alert you, regardless of your marketing preferences. Please follow the instructions provided. Do not consume any recalled product.

16. Complaints and dispute resolution

Please contact us first at contact@walmth.co.uk]. We aim to acknowledge complaints within 10 working days and resolve them within 28 days. Food safety concerns can also be reported to your local Environmental Health team or the Food Standards Agency at food.gov.uk.

17. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the one published on the Site at the time of order.

18. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales, Scotland and Northern Ireland. Disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales. As a consumer, you may also bring proceedings in the courts of the UK nation where you live.
